01. ELIGIBILITY
You must be at least 18 years of age and legally capable of entering into a binding agreement to use the Services.
02. USERS ACCOUNT
Users are responsible for:
- Providing accurate information.
- Keeping login credentials confidential.
- Maintaining the security of their account.
- Promptly notifying @Shot of any unauthorized use of their account.
Users are responsible for all activity conducted through their accounts.
03. OUR SERVICES
@Shot provides a technology platform that connects customers, businesses, and independent drivers for delivery services.
@Shot is not the manufacturer or seller of the goods being transported unless expressly stated.
04. DELIVERY REQUESTS
Customers are responsible for ensuring that:
- Pickup and delivery addresses are accurate.
- Recipient information is correct.
- Items are properly packaged unless packaging services are specifically requested.
- Items being shipped are lawful and safe to transport.
05. PROHIBITED ITEMS
The following may not be transported through @Shot unless specifically authorized:
- Illegal drugs or controlled substances
- Firearms or ammunition (unless legally authorized)
- Explosives
- Hazardous materials
- Stolen property
- Counterfeit goods
- Any item prohibited by applicable law
@Shot reserves the right to refuse or cancel any delivery involving prohibited items.
06. DRIVER RESPONSIBILITES
Drivers agree to:
- Maintain all legally required licenses, insurance, and registrations.
- Operate vehicles safely and lawfully.
- Deliver items with reasonable care.
- Follow all applicable traffic laws.
- Maintain professional conduct while providing services.
Drivers are independent contractors unless otherwise agreed in writing.
07. PAYMENTS
Customers agree to pay all applicable charges associated with each delivery.
Charges may include:
- Delivery fees
- Distance-based charges
- Additional service fees
- Taxes where applicable
Payments are processed securely through approved payment providers.
08. CANCELLATIONS
Customers may cancel deliveries subject to any applicable cancellation fees if the driver has already been assigned or has begun traveling to the pickup location.
@Shot reserves the right to cancel any order that cannot be safely or legally completed.
09. DELAYS
Estimated delivery times are estimates only.
Delays may occur due to:
- Traffic
- Weather
- Road closures
- Vehicle issues
- Customer availability
- Circumstances beyond @Shot’s reasonable control
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, @Shot shall not be liable for:
- Indirect damages
- Consequential damages
- Lost profits
- Business interruption
- Delays outside our reasonable control
Our liability for any claim relating to a delivery shall not exceed the amount paid for that delivery, except were prohibited by law.
11. LOST OR DAMAGE ITEMS
Customers should inspect deliveries promptly.
Claims for loss or damage should be submitted within the timeframe specified by @Shot’s claims process.
Compensation, if applicable, will be determined based on the circumstances of each claim and any applicable insurance coverage.
12. INTELLECTUAL PROPERTY
The @Shot name, logo, mobile application, website, software, graphics, trademarks, and related content are the property of Fush Technology LLC and may not be copied, reproduced, or used without written permission.
13. SUSPENSION OR TERMINATION
@Shot may suspend or terminate any account that:
- Violates these Terms.
- Engages in fraudulent activity.
- Misuses the platform.
- Threatens the safety of users or drivers.
- Violates applicable laws.
14. PRIVACY
Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
15. THIRD -PARTY SERVICES
Our platform may use third-party services, including payment processors, mapping providers, notification services, and identity verification providers.
Use of those services may also be subject to the terms and privacy policies of those providers.
16. MODIFICATIONS
We may modify these Terms from time to time.
Updated versions will be posted through our website or application. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
17. GOVERNING LAW
These Terms shall be governed by the laws applicable to Fush Technology LLC, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate courts having jurisdiction over such matters.
